Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://calgaryonlinelearning.ca website (the “Service”) operated by Calgary Online Learning Centre (“us”, “we”, or “our”).

Your access to and use of the Calgary Online Learning Centre Online Homeschooling Hub is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all Calgary Online Learning Centre Hub clients who access and use the Online Homeschooling Hub.

Some of these Terms are also applicable to visitors of our company website and Online Homeschooling Hub under a “Guest” account.

By accessing our company website, https://calgaryonlinelearning.ca or using the Hub at https://hub.calgaryonlinelearning.ca you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Hub or Services.

C.O.L.C. Acronym

C.O.L.C. is an acronym for Calgary Online Learning Centre

Definition of C.O.L.C. Online Homeschooling Hub

It is to be understood that C.O.L.C. Hub is NOT an educational school, nor do we offer teaching of homeschooling students. We offer an online administrative learning Hub for homeschooling teachers and their students which also accommodates special needs individuals with learning disabilities. We are not affiliated with any provincial or district school system or board. However, the content of the C.O.L.C. Online Homeschooling Hub is in accordance with provincial and municipal education governments.

Use of Demo C.O.L.C. Hub

The purpose of this demonstration version is for potential new clients to get a “test drive” of what they are interested in prior to purchasing enrollment membership.

These conditions apply:

  • The “Demo Hub” is strictly sample-only and does not contain the actual curriculum that will be used in a client’s teacher or student portals. The contents of the demo Hub is placed so it is not empty of course content.
  • This Hub is only for viewing and MUST not be altered in any way. This applies to both teacher and student demo Hubs.
  • Downloading of files are NOT permitted in the C.O.L.C. Demo Hub via the demo teacher hub. The student demo hub is not able to download files.
  • The conditions you see below at heading, “Improper or Illegal Use of C.O.L.C. Hub” also apply to the use of the demo Hub.

Refund Policy

  • Payment for full school year Hub service: It can be paid up front for the school year. Comes with full 30 Day Money Back Guarantee in accordance with our Terms and Conditions policy. This service does NOT provide a free “Trial” of the Hub and will NOT be treated as such in order to get their money back. The reasons for requesting a refund and cancellation of service must be due to technical misfunctions that cause dis-satisfaction of our hub service or the student is unable to learn with the aid of our Hub. After 30 days of purchase, a refund will not be given.
  • Month-to-month payment with monthly installments Hub service: Cost is $50.00/month. Comes with full 7 Day Money Back Guarantee in accordance with our Terms and Conditions policy. This service does NOT provide a free “Trial” of the Hub and will NOT be treated as such in order to get their money back. The reasons for requesting a refund and cancellation of service must be due to technical misfunctions that cause dis-satisfaction of our hub service or the student is unable to learn with the aid of our Hub. After 7 days of purchase, a refund will not be given.

Liability of Calgary Online Learning Centre to it’s Clients

The liability of Calgary Online Learning Centre is to provide a reliable and fully functional online education hub for individuals who choose to homeschool their children. The Hub must remain available on the internet at all times for clients who are within their all-ready paid cycle.

It is the liability of Calgary Online Learning Centre to provide all technical services and support to it’s clients in regards to the functioning of their account and individual Hub technical issues.

Calgary Online Learning Centre is NOT liable for the success of an online student’s learning. Since C.O.L.C. is not a school or a teacher and is providing this Hub for individuals who are homeschooling their children, we can not be liable for the quality and delivery of teaching. However, we stand by being the best quality of service we can be to our clients.

Teacher and Student Accounts

When you register for the Hub service at our website, an account is created with us. You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the Hub login credentials (username and password) that you use to access the Online Hub for all educational activities and actions under your password.

You agree not to disclose your Hub login credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. If you forget your password and can not retrieve it, we will reset your password. Please allow 5 to 10 minutes prior to logging into the Hub.

Improper or Illegal Use of C.O.L.C. Hub

The Hub is only for educational purposes; therefore only educational information is permitted within a client’s Hub account. Any posted information that is on a teacher or student’s portal that is not education related, pornography, hate or racism or other illegal content will invoke an immediate termination of the client’s account with C.O.L.C. Online Hub. Any monies paid for service will NOT be refunded.

Each teacher and student portal has their own Hub and their own login credentials. The Hub client on the account is responsible for their own login credentials. Distribution of login credentials to 3rd parties, will also invoke an immediate account termination.

Provisions to Termination: Each Hub account is SSL encrypted regularly scanned for viruses. It must be proven that a client’s Hub has been compromised. If a client’s Hub has been hacked, then termination does NOT apply. The client must report anything that they or their students did not post to Calgary Online Learning Centre as soon as it is observed in their Hub.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Calgary Online Learning Centre and its licensors. Any distribution of login credentials to a teacher or student’s Hub to 3rd parties, will breach the Terms and Conditions contract; hence, immediate termination of services and account will occur. Any duplication of Hub artistic or text content that is distributed to 3rd parties for purposes of profit will face litigation in court.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Calgary Online Learning Centre.

Calgary Online Learning Centre has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Calgary Online Learning Centre shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Client Cancellation of Hub Account

We require 30 days notice from clients who want to cancel their accounts and C.O.L.C. Hub services. Their Hub will be deleted at midnight of the 30 days. The notice must be in writing either in a mailed letter to our address or an email sent to: [email protected]. A refund will NOT be honoured if applicable unless these conditions occur. See our Refund Policy above.

Termination

We may terminate or suspend access to our online education Hub service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the C.O.L.C. Hub will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
